Employment & Civil Mediation

What is employment and civil mediation?

Employment and civil mediation provides a confidential, efficient and cost-effective way to resolve disputes without the need for tribunal or court proceedings. It allows parties to retain control over outcomes, reduce cost and stress, and reach practical solutions that litigation often cannot achieve.

Workplace Consensus offers employment and civil mediation on a focused, personal basis, ensuring continuity and consistency throughout the process.

When employment and civil mediation is appropriate

Employment mediation is most commonly used where the employment relationship has ended and a dispute has arisen between an employer and an employee. In many cases, the dispute involves an existing or potential claim in the Employment Tribunal, and in some circumstances proceedings in the civil courts.

Civil mediation is also effective in resolving disputes connected to the workplace or business relationships, including disputes between shareholders, directors or former colleagues.

Most employment and civil mediations are completed within a single day and take place in a structured, confidential setting designed to support constructive negotiation.

Why choose mediation?

Mediation offers clear advantages over formal litigation:

  • Confidential and without prejudice
  • Faster resolution than tribunal or court proceedings
  • Significantly lower cost
  • Flexible and practical outcomes tailored to the parties’ needs
  • Reduces conflict and protects professional relationships where appropriate

Mediation does not require agreement on legal liability. The focus is on identifying solutions that work for the parties and allow them to move forward.

The Workplace Consensus approach

Workplace Consensus is a specialist mediation practice led by an experienced employment lawyer and former employment judge. The practice combines deep legal understanding with a practical, solution-focused approach to dispute resolution.

All mediations are conducted personally, ensuring that parties work directly with the mediator from initial discussions through to the conclusion of the mediation. The approach is impartial, calm and pragmatic, helping parties to identify the real issues in dispute, test assumptions and explore realistic options for settlement.

Types of disputes mediated

Workplace Consensus mediates a wide range of employment, discrimination and civil disputes, including:

  • Unfair dismissal
  • Discrimination and harassment
  • Breach of contract
  • Settlement (compromise) agreement disputes
  • Redundancy payments
  • Employment references
  • Restrictive covenants and confidentiality
  • Data protection disputes
  • TUPE-related disputes
  • Shareholder and director disputes

Preparing for mediation

Preparation is key to a successful mediation. Parties who are well prepared are significantly more likely to reach settlement on the day.

Guidance on how to prepare for an employment or civil mediation, together with an overview of what to expect during the process, is available in the accompanying guidance note. Legal representation is welcome, but mediation remains a party-led process focused on resolution rather than advocacy.

Next steps

If you are considering employment or civil mediation, or would like to discuss whether mediation is appropriate for a particular dispute, Workplace Consensus offers an initial, confidential discussion.

Online Mediation

The use of online mediation became very popular throughout the Pandemic and I continue to offer this service in cases where face to face mediation is difficult.

Although the concept of online mediations may be unfamiliar to some, I have found that they work well and the systems I use are easy to use and access.

I am happy to use either Zoom or Teams with both platforms allowing for a normal online meeting together with private 'breakout' rooms for the participants.  These 'breakout' rooms closely simulate the private meeting room arrangements of a face-to-face mediation as different parties and their representatives can be brought together and can ‘meet’ privately with the mediator in their private 'breakout' rooms.
